  • The court ruled that Sonko had submitted all the requisite documents to the IEBC for clearance on time.
  • At the same time, the three-judge bench of Olga Sewe, Ann Ong’injo’, and Stephen Githinji noted that the former Governor has an appeal pending at the Supreme Court and has not exhausted his options for contesting his impeachment.

The Mombasa High Court has now ordered the IEBC to clear former Nairobi Governor Mike Sonko to run for the Mombasa governorship.

The court ruled that Sonko had submitted all the requisite documents to the IEBC for clearance on time. 

At the same time, the three-judge bench of Olga Sewe, Ann Ong’injo’, and Stephen Githinji noted that the former Governor has an appeal pending at the Supreme Court and has not exhausted his options for contesting his impeachment.

In question was Sonko’s eligibility to run for governor of Mombasa after being impeached by the County Assembly of Nairobi.

While IEBC and DRC’s legal teams fought back to demonstrate that the former Nairobi Governor is ineligible to run for the position, Sonko’s legal team argued that the IEBC Disputes Resolutions Committee erred in its decision to disqualify the former Governor from running and pleaded with the judges to grant Sonko’s request.
