State prosecutor has asked Iganga magistrate court to reinstate a criminal case against top president Museveni critique Kakwenza Rukirabashaija.

The Director of public Prosecution (DPP) penned a letter through its senior state prosecutor asking court to reinstate Uganda vs Kakweeza Rukirabashaija CIDHQTSE1462020 case.

Whisper Eye has learnt that Beatrice Owor a state prosecutor in Iganga informed the Trial Magistrate that the state is very ready to prosecute Mr Kakwenza the author of the Banana Republic over the criminal case which was dismissed in August 2020 over want of prosecution.

A Case may be dismissed for want of prosecution where the complainant fails to appear in court to support prosecution of a case lodged against an accused person.

Your Worship , we are now ready to proceed since witnesses are now ready to come and testify after the government partially lifting lock down. Owor Beatrice stated .

We humbly pray that the case be reinstated so as we can prosecute the same. Owor Beatrice added.

The 33 year old was arrested at his home in Kigulu , Iganga district on 13th April 2020 and held in what he described as a notorious place and conditions.

After the intervention from his lawyers and the FDC former president general rtd Col Dr Kizza Besigye , Mr Kakwenza was arraigned before Iganga Magistrates court after close to 9 days and charged with doing an act likely to spread the infection of disease as per laws of Uganda under the penal code act.

Uganda claims the writer at blacksstarnews.com risked lives of people while using his Facebook account in April 2020.

The charge sheet stated partly that the accused unlawfully/negligently posted messages on his Facebook account mobilizing the public against complying with directives and public health guidelines issued to prevent the spread of covd-19 .

The same case was dismissed by the same court on 14th August 2020 .

Reacting on state decision to reinstate the case against Kakwenza , Col Kizza Besigye said , Persecution by your “government” really sucks! Mr Kakwenza’s only crime is publishing a book, whose content displeased a person exercising power.

There’s never any real intention to prosecute the accused because the charges are just trumped-up.

The real intention is to (ab)use their power and court process to psychologically &physically torture and financially cripple their victim. Besigye stated .

Stand firm Mr Kakwenza; adversity is a passing wave. The truth always prevails. Besigye advised .

Mr Kawenza is also the author of the most selling book in Uganda known as The Greedy Barbarian which also landed him to Kireka SIU.
